الشروط والأحكام
١ — من نحن
«مرسى» منصة سعودية تعمل من جدة تربط بين ركاب يبحثون عن تجربة بحرية وكباتن مرخّصين من خفر السواحل يقدمون رحلاتهم بقواربهم. مرسى وسيط تقني ومنظّم للحجز والدفع — الرحلة نفسها عقد بين الراكب والكابتن، والكابتن هو المسؤول عن قيادة الرحلة وسلامة تشغيلها.
٢ — الحساب
- التسجيل برقم جوال سعودي ورمز تحقق؛ أنت مسؤول عن ما يتم عبر حسابك.
- الحد الأدنى لعمر صاحب الحساب ١٨ سنة.
٣ — الحجز والدفع
- الأسعار بالريال السعودي وتشمل ضريبة القيمة المضافة حيثما تنطبق، وتظهر لك كاملة قبل تأكيد الدفع — بلا رسوم مخفية.
- الدفع داخل المنصة حصراً عبر مزوّد الدفع المرخّص «ميسر» (مدى، البطاقات، STC Pay، Apple Pay).
- مبلغك يبقى محفوظاً لدى مرسى ولا يُحوَّل للكابتن إلا بعد اكتمال الرحلة — هذه حمايتك الأساسية.
- على الكابتن قبول طلب الحجز قبل ١٢ ساعة على الأقل من موعد الرحلة، وإلا أُلغي الطلب واسترجعت مبلغك كاملاً.
- الإلغاء والاسترجاع وفق سياسة الإلغاء والاسترجاع.
٤ — السلامة والالتزام بالأنظمة
- كل كابتن على المنصة موثّق برخصة سارية من خفر السواحل قبل ظهور قاربه.
- قائمة ركاب رسمية تُجهَّز لكل رحلة وفق متطلبات الجهات المختصة، ويلتزم الراكب بتزويد أسماء صحيحة.
- يلتزم الجميع بتعليمات السلامة وتوجيهات الكابتن أثناء الرحلة، وبأنظمة هيئة البحر الأحمر وخفر السواحل.
- يمنع استخدام المنصة لأي نشاط مخالف للأنظمة، ومن ذلك بيع مصيد الرحلات الترفيهية.
٥ — التواصل داخل المنصة
يتاح التواصل بين الراكب والكابتن عبر محادثة داخل التطبيق قبل الرحلة وبعدها بفترة محددة. حفاظاً على حماية الطرفين وضمانات الدفع، تُخفى أرقام الجوال في المحادثات، ويُعد الالتفاف على المنصة لإتمام حجوزات خارجها إخلالاً بهذه الشروط.
٦ — التقييمات
بعد كل رحلة يقيّم الراكب الكابتن، ويقيّم الكابتن تجربته مع الراكب. تُعرض تقييمات الركاب للكباتن الآخرين بشكل مجمّع لضمان جودة المجتمع، وفق سياسة الخصوصية.
٧ — التزامات الكابتن
- سريان رخصة خفر السواحل وصلاحية القارب ومعدات السلامة طوال فترة العمل على المنصة.
- الالتزام بمواعيد الرحلات؛ وعند الإلغاء المتأخر (أقل من ٢٤ ساعة) أو عدم الحضور يتحمل الكابتن غرامة ١٠٠ ريال تُضاف لمحفظة الراكب تعويضاً.
- تُحوَّل الأرباح لحساب الكابتن البنكي بعد اكتمال كل رحلة، وتتاح ميزة الدفع المبكر وفق مستويات الشركاء المعلنة في التطبيق.
٨ — حدود المسؤولية
تبذل مرسى عنايتها في التحقق من تراخيص الكباتن وتنظيم الدفع الآمن، غير أن تشغيل الرحلة وسلامتها البحرية مسؤولية الكابتن المرخّص. لا تتحمل مرسى الأضرار غير المباشرة، وتبقى مسؤوليتها في كل الأحوال بحدود قيمة الحجز محل النزاع، وذلك دون إخلال بما تقرره الأنظمة السعودية.
٩ — النظام المطبق
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وأي نزاع يُحال للجهات المختصة في مدينة جدة بعد تعذر الحل الودي عبر [email protected].

قد تُحدَّث هذه الشروط، وسنشعرك بالتغييرات الجوهرية داخل التطبيق قبل سريانها.
Terms & Conditions
1 — Who we are
Marsa is a Saudi platform operating from Jeddah that connects passengers looking for a sea experience with Coast Guard–licensed captains offering trips on their boats. Marsa is a technology intermediary that organizes booking and payment — the trip itself is a contract between passenger and captain, and the captain is responsible for operating the trip safely.
2 — Your account
- Registration uses a Saudi mobile number and a verification code; you are responsible for what happens through your account.
- Account holders must be 18 or older.
3 — Booking and payment
- Prices are in Saudi Riyals and include VAT where applicable, shown in full before you confirm payment — no hidden fees.
- Payment happens exclusively in-platform via the licensed payment provider Moyasar (mada, cards, STC Pay, Apple Pay).
- Your money is held by Marsa and only released to the captain after the trip completes — this is your core protection.
- Captains must accept booking requests at least 12 hours before departure; otherwise the request is cancelled and you receive a full refund.
- Cancellations and refunds follow the Cancellation & Refund Policy.
4 — Safety and compliance
- Every captain on the platform is verified against a valid Coast Guard license before their boat appears.
- An official passenger manifest is prepared for every trip per regulatory requirements; passengers must provide accurate names.
- Everyone must follow safety instructions and the captain's directions during the trip, and the regulations of the Saudi Red Sea Authority and the Coast Guard.
- Using the platform for any activity that violates regulations is prohibited — including selling the catch of recreational trips.
5 — In-platform communication
Passenger–captain chat is available in-app before the trip and for a limited period after it. To protect both sides and the payment guarantees, phone numbers are masked in chats, and circumventing the platform to complete bookings outside it is a breach of these terms.
6 — Reviews
After each trip, the passenger rates the captain, and the captain rates their experience with the passenger. Passenger ratings are shown to other captains in aggregate form to maintain community quality, in line with the Privacy Policy.
7 — Captain obligations
- Keep the Coast Guard license, boat seaworthiness, and safety equipment valid throughout their time on the platform.
- Honor trip schedules; late cancellation (under 24 hours) or no-show incurs a 100 SAR penalty credited to the passenger's wallet as compensation.
- Earnings are transferred to the captain's bank account after each trip completes; early payout is available per the partner levels published in the app.
8 — Limitation of liability
Marsa exercises care in verifying captain licenses and organizing secure payment; however, operating the trip and its maritime safety are the licensed captain's responsibility. Marsa is not liable for indirect damages, and its liability is in all cases capped at the value of the disputed booking, without prejudice to Saudi law.
9 — Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia; disputes go to the competent authorities in Jeddah after amicable resolution fails via [email protected].
10 — Updates
These terms may be updated; we will notify you in-app of material changes before they take effect.
